Terms and Conditions

Article 1. Applicability

1.1 These general terms and conditions apply to all offers, orders and agreements from Isla Ibiza.i.e.
1.2 By placing an order or accepting an offer, you agree to these terms and conditions.
1.3 Deviation from these conditions is only possible in writing. All other provisions will then remain in full force.
1.4 All rights and claims in these terms and conditions also apply to intermediaries and other third parties served by Isla Ibiza.nl are enabled.

Article 2. Offers & agreements

2.1 All offers from Isla Ibiza.nl are without obligation. We reserve the right to change prices, especially if required by law (see also clause 3.6).
2.2 An agreement is only concluded after acceptance of your order Isla Ibiza.en. We reserve the right to refuse orders or impose additional conditions.
2.3 After ordering, the agreed price applies and can no longer be adjusted in the event of price reductions. You do have a legal cooling-off period of 14 days to cancel your purchase without giving a reason.

Article 3. Prices & payments

3.1 All prices are in euross, including VAT, but excluding shipping costs or other additional charges, unless stated otherwise.
3.2 Payment must be made in advance via the available payment methods: iDEAL, PayPal, Visa, Mastercard, Maestro, Sofort Banking.
3.3 In the event of late payment Isla Ibiza.nl the right to suspend or cancel delivery.
3.4 In the event of a price increase after ordering, you have 10 days to cancel your order.
3.5 Orders outside the EU: Please take import duties into account. Outside the EU you do not pay 21% VAT, but import duties may apply to orders above €150.

Article 4. Delivery

4.1 The stated delivery times are an indication and do not give any right to compensation if they are exceeded.
4.2 Delivery takes place when the products are ready for shipment.

Article 5. Retention of title

5.1 The products remain the property of Isla Ibiza.nl until the full purchase amount has been paid. However, the risk of the products passes upon delivery.

Article 6. Intellectual property

6.1 All intellectual property rights of the products remain the property of Isla Ibiza.nl or the original rights holders.
6.2 Isla Ibiza.nl does not guarantee that the delivered products do not infringe the intellectual property rights of third parties.

Article 7. Complaints & returns

7.1 Check upon delivery whether the products comply with the agreement. Please report any discrepancies within 7 days of receipt via email.
7.2 In the event of a justified complaint: Isla Ibiza.nl replace the product or refund the invoice value.
7.3 Returns without reason can be made within 14 days, provided the product and packaging are undamaged. Return costs are at your own expense. The return shipment is at your own risk, Isla Ibiza.nl is not liable for loss or damage during return shipment.

Article 8. Warranty

8.1 Isla Ibiza.nl offers a warranty according to the conditions of the manufacturer or supplier.
8.2 Complaints about visible defects must be reported in writing within 7 days of receipt.

Article 9. Orders & communication

9.1 Isla Ibiza.nl is not liable for miscommunication, delays or errors due to internet use or other means of communication, unless there is intent or gross negligence.

Article 10. Force majeure

10.1 In the event of force majeure Isla Ibiza.nl suspend delivery or terminate the agreement, without compensation being due.
10.2 Force majeure includes all circumstances that are beyond our control and that make the execution of the agreement impossible.

Article 11. Miscellaneous

11.1 Your specified address will be used for delivery, unless otherwise stated.
11.2 Failure to immediately enforce a provision does not mean that Isla Ibiza.nl waives its rights.
11.3 If a provision proves to be invalid, the rest of the terms and conditions will remain in full force and effect.
11.4 Isla Ibiza.nl may engage third parties for the execution of orders.

Article 12. Discount codes

12.1 Discount codes are valid for a limited period and do not apply to previous orders or shipping costs.
12.2 If you return a product for which a discount code has been used, the discount will expire.
12.3 Discount codes cannot be exchanged for money and may not be changed, falsified or used commercially.
12.4 Every (attempted) fraud will be registered and will lead to exclusion from further participation.
12.5 Discount codes cannot be combined with other discount promotions.

Article 13. Applicable law & disputes

13.1 All agreements and these conditions are exclusively governed by Dutch law.
13.2 Disputes will be submitted exclusively to the competent court in the Netherlands.

Article 14. Liability

14.1 Isla Ibiza.nl is not liable for inaccuracies in product information provided by third parties.
